Terms of Sale

This Terms of Sale Agreement (the "Agreement") is entered into between you ("Customer" or "you") and NuAromas Company, Inc., including all affiliates and subsidiaries (collectively "we," "us," or "NuAromas"). By submitting an order, you affirm that you have read, understood, and agree to be bound by the terms outlined herein. If you do not agree with these terms, please refrain from making a purchase on our website.

Acceptance of Terms

By placing an order, you:

Consent to enter into this Agreement electronically.
Acknowledge that your order submission constitutes your electronic signature and full acceptance of this Agreement.

Orders and Order Acceptance

Upon placing an order, you confirm that all information provided is accurate and complete. NuAromas reserves the right, at its sole discretion, to accept or reject any order for any reason, including but not limited to product availability, pricing errors, or suspected unauthorized resale. Orders are considered final upon submission and may not be altered or canceled unless the item is out of stock or unavailable.

If discrepancies are identified in your order confirmation, please contact Customer Service immediately. Failure to notify us promptly may result in additional fees or delays, for which NuAromas is not responsible.

Product Availability and Backorders

We strive to provide accurate stock information; however, stock availability is subject to change without notice. If an item becomes unavailable after you place an order, we reserve the right to cancel your order for that item and issue a full refund if payment has been made. NuAromas is not liable for any losses or damages arising from product unavailability beyond the refund of the purchase price.

Product Descriptions and Warranty Disclaimers

NuAromas endeavors to maintain accurate product descriptions. However, we do not guarantee that all content on our website is free from errors. Minor variations in color, size, or style do not constitute grounds for return or refund unless they materially impact the product’s function. Any warranties applicable to our products are expressly set forth on our website under each product’s link. NuAromas disclaims all other warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose, except where prohibited by law.

Replacement Parts and Product Compatibility

Replacement parts, if available, are provided for specific product models only. NuAromas makes no guarantees regarding the compatibility or safety of replacement parts ordered for models other than the intended product. In cases of unavailability, we reserve the right to substitute parts with similar colors, patterns, or styles at our discretion.

Pricing and Payment Terms

All prices are listed in U.S. Dollars and exclude shipping, handling, and applicable taxes. In the event of pricing errors, we reserve the right to refuse or cancel orders for the mispriced product. If you have already been charged, a credit will be issued to your payment method. Prices are subject to change without prior notice. Additional taxes, fees, and surcharges may apply depending on your location.

Promotional Codes

Promotional codes are subject to specific terms and conditions, which are displayed with each promotion. NuAromas reserves the right to modify, suspend, or terminate any promotion at its sole discretion.

Pre-Order Terms

Orders containing pre-order items will ship once all items are in stock. If you wish to receive in-stock items sooner, please place a separate order. Estimated shipping dates for pre-order items are provided on the product page and are subject to change. NuAromas is not liable for any delays or changes in pre-order shipping estimates.

Restrictions on Resale

Products purchased from NuAromas are for personal, non-commercial use only. Unauthorized resale is strictly prohibited. We reserve the right to cancel orders that appear to exceed reasonable personal use quantities or appear intended for resale, and the Customer will be notified accordingly.

Shipment, Delivery, and Transfer of Risk

All orders are shipped via carriers selected by NuAromas. Delivery dates are estimates and are not guaranteed. NuAromas is not liable for delays once the order has been dispatched to the carrier. Risk of loss and title to the goods transfer to the Customer upon the carrier’s receipt of the shipment. We recommend inspecting all items upon delivery and reporting any damages directly to the carrier.

Returns Policy

Returns are accepted only for products purchased directly from our website, in accordance with our posted Return Policy. We do not accept returns for items purchased through third-party retailers. Return shipping costs are the Customer’s responsibility, and we strongly recommend using a trackable and insured shipping method. Returns not in compliance with our policy, or without proper tracking, will not be accepted. NuAromas reserves the right to reject returns not meeting policy requirements.

Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, NU AROMAS DISCLAIMS LIABILITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THIS AGREEMENT, EVEN IF ADVISED OF SUCH DAMAGES' POSSIBILITY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM, REGARDLESS OF THE BASIS, SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT IN QUESTION. SOME JURISDICTIONS MAY NOT ALLOW CERTAIN LIABILITY LIMITATIONS; THIS LIMITATION IS VOID, INAPPLICABLE, OR UNENFORCEABLE WHERE PROHIBITED.

Electronic Communications

By using our website, you consent to receive electronic communications from us. Such communications satisfy any legal requirement for written communication. This consent applies solely to the current transaction; additional transactions will require new consent. For our full policy, please refer to our Privacy Policy.

Severability and Terms of Use

This Agreement incorporates NuAromas' Terms of Use, available on our website. In case of any conflict between this Agreement and our Terms of Use or Privacy Policy, this Agreement prevails. If any term in this Agreement is deemed invalid or unenforceable, all other terms shall remain valid and enforceable.

Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the State of Tennessee, USA, without regard to conflict of law principles. The Customer consents to the exclusive jurisdiction and venue of the state and federal courts in Tennessee for any disputes arising from this Agreement. Any objections to jurisdiction or venue are waived to the fullest extent permitted by law.
